CONSTRUCTION LIEN CLAIMANTS

If you have supplied work or materials for the improvement of a property, you may be entitled to a construction lien. The lien must be preserved within 45 days of the date of substantial completion. Except for projects owned by the Crown or municipal roadways, preservation is done by registration of a lien against the title to the land in the land registry office. The lien must be perfected within 45 days of the last date that it could be preserved. A lien is perfected by the commencement of an action and the registration of a certificate of action against title to the land.

If you are a potential lien claimant, it is important that you contact us well before the expiry of the 45 day period to ensure that we are available, and a title search can be obtained for the land.

The completion of the following form will give us the information that will allow us to complete your lien in a timely manner.

As well as the following form, please forward a copy of your:
  1. Construction contract
  2. Any change orders
  3. Approvals for any extras
  4. Calculation of prices for extras
  5. Outstanding invoices and statements
